These Terms of Service ("Terms") govern your access to and use of the SelfAI - AI Photo Studio application and website (the "Service") operated by Rocket Digital Limited("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

By downloading, installing, or using SelfAI, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you may not use the Service. You must be at least 13 years old to use the Service.

2. Description of Service

SelfAI is an AI-powered photo studio application that generates professional headshots, portraits, and creative photos from user-uploaded selfies. The Service is available on iOS, Android, and the web. Features include AI headshot generation, multiple portrait styles, business photo creation, and AI photo editing.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information when creating an account.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

• Certain features of the Service require a paid subscription.
• Subscription payments are processed through the Apple App Store, Google Play Store, or RevenueCat depending on your platform.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Prices may change with reasonable notice. Existing subscribers will be notified before any price increase takes effect.
• Refunds are handled according to the policies of the respective app store (Apple or Google) through which you purchased your subscription.

5. User Content and Photos

5.1 Your Content

• You retain ownership of the photos you upload to the Service.
• By uploading photos, you grant us a limited license to process and transform your photos solely for the purpose of providing the Service.
• You represent that you have the right to upload any photos you submit and that your photos do not violate any third-party rights.

5.2 AI-Generated Content

• You own full commercial rights to AI-generated headshots and portraits created through the Service.
• You may use AI-generated images for personal, professional, and commercial purposes including LinkedIn profiles, resumes, websites, and social media.
• We do not claim ownership over AI-generated content created for you through the Service.

5.3 Prohibited Content

You may not upload or generate content that:

• Contains explicit, pornographic, or sexually suggestive material.
• Depicts violence, hate speech, or discrimination.
• Infringes on intellectual property rights of others.
• Contains photos of individuals without their consent.
• Is intended to deceive, defraud, or impersonate others.
• Violates any applicable laws or regulations.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Use automated systems (bots, scrapers) to access the Service.
• Interfere with the proper functioning of the Service.
• Share your account credentials with others.
• Use AI-generated images to create misleading or fraudulent identity documents.

7. Third-Party Services

The Service integrates with several third-party services:

• Firebase: Authentication and backend services provided by Google.
• RevenueCat: Subscription and payment management.
• Google AdMob: Advertising services.
• OpenAI: AI processing capabilities.
• Microsoft Azure: Cloud computing and AI services.
• Replicate: AI model hosting.
• Fal.ai: AI inference infrastructure.

Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the practices of third-party services.

8. Intellectual Property

• The Service, including its design, code, AI models, and branding, is owned by Rocket Digital Limited and protected by intellectual property laws.
• The SelfAI name, logo, and associated branding are trademarks of Rocket Digital Limited.
• You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that AI-generated images will meet specific quality standards or be suitable for any particular purpose. Results may vary depending on the quality and variety of uploaded photos.

10. Limitation of Liability

To the maximum extent permitted by law, Rocket Digital Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Rocket Digital Limited and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

• You may terminate your account at any time by contacting us or deleting your account through the app.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your right to use the Service ceases immediately. AI-generated images you have already downloaded remain yours.

13. Governing Law

These Terms are governed by the laws of Hong Kong SAR, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Hong Kong SAR.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
